Do I REALLY have to pay sales tax...I live out of state? Customers want to pay the absolute lowest NET price for their equipment. Many customers believe that they can "get out of paying sales tax" on anything that is purchased out of their state. Here is an example of both the seller™s responsibility to collect and a buyer™s responsibility to pay state sales tax. We will use Greg Smith Equipment as the "seller" and define our obligations (as a company) to collect state sales tax and the customer™s responsibility to pay state sales tax.

Greg Smith Equipment has multiple brick and mortar locations in the USA. Three of the states (Delaware, New Hampshire, and Oregon) have NO state sales tax. The other five (5) states (Indiana, Georgia, Texas, Florida, and Arizona) have a state sales tax.

Let's assume that a customer (Either a business owner or Mr. Homeowner from Ohio) orders a lift from our Indiana store. He wants to have it shipped via Commercial Common carrier to his location. The cost of the lift is $2295.00 and the freight cost is $200. Greg Smith Equipment would charge the customer $2495.00 and ship the lift to the designated out of state location. The customer would be responsible for declaring his "out of state" purchase to the State of Ohio and also be responsible for paying that sales tax (or use tax) to Ohio. Greg Smith Equipment is not authorized to collect out of state sales tax on products shipped (out of state) by a commercial carrier (Commercial truck line, UPS or Fed-Ex for example), unless it is shipped to a state where there is a GSE store.

There are several automotive equipment distributors that advertise on the Internet claiming to have multiple warehouse locations throughout the USA. These Internet companies want to appear "BIG", but they are really just very small operations who rely on other independently owned warehouses to stock and ship products. Actually, these "Internet distributors" do not own nor have any partial ownership in "their warehouses located all over the USA". If they really had ownership, they would be guilty of not collecting or paying appropriate state sales tax.

An online business is responsible for paying sales tax in states where it has NEXUS. For example, an online business will have to pay sales tax on orders shipped to states where it has offices or warehouse facilities. It will not have to pay sales tax on orders shipped to states where it has no physical presence.

Nexus determines whether an online business has to pay sales tax on orders shipped to a certain state. Nexus refers to the connection that a business has with a given state. If the business has nexus (a connection) with a state it will be responsible for collecting and paying sales tax on orders shipped to that state. Conversely, a business will not have to collect sales tax on orders shipped to a state where it does not have nexus.

Tax law is constantly evolving, so it's best to check with your tax professional regarding the current scope of nexus for various states. However, the 1992 Supreme Court ruling in the case of Quill Corp. v. North Dakota still largely defines nexus concerning sales tax. In this case, the Supreme Court ruled that a business must have a physical presence in a state for that state to require it to collect sales taxes.

If these Internet automotive equipment distributors (who claim to have warehouses in Arizona, Texas, California, Idaho, Michigan, Nevada, New York, Ohio, Mississippi, Massachusetts, and Florida) are NOT collecting state sales tax when shipping products to customers in the states listed above, only two conclusions can be drawn:

These Internet Distributors do not really have any ownership in the above listed warehouse locations or these Internet Distributors (if they do have ownership ((NEXUS)) in these warehouses) are breaking the law by not collecting the appropriate sales tax for each State.

Only one of those two conclusions can be drawn from the facts. Either these distributors are lying about the size (and ownership) of their organization OR they are breaking the law by not collecting the appropriate sales tax (and offering this non-collection of sales tax) as a "discount" to the customer.

Do you really want to do business with a company that operates on these principles? These companies are putting themselves at risk of being exposed as a company that is not truthful in their advertising and/or at a larger and more punitive risk of being brought to the attention of state tax agencies in all the states listed above for failure to collect appropriate sales tax. The (11) independently owned warehouses (located in the various states listed above) are also putting themselves at risk by shipping products into their own state without either collecting sales tax or being furnished with the correct sales tax exemption documentation.

All consumers want the highest quality equipment at the lowest possible price. Greg Smith Equipment is committed to provide that value to our customers. Greg Smith Equipment will not œbend nor break the sales tax laws to gain an unfair price advantage. Greg Smith Equipment really does own or lease eight (8) brick and mortar locations (nexuses) located throughout the USA. We have been in business for over thirty years and plan on being around for a few more decades. We know the sales tax laws and we take our responsibility to enforce them very seriously.

You should consult your tax adviser and/or attorney to determine what impact, if any, sales tax may have on your tax situation.

The short answer is yes. We do charge applicable sales tax in Indiana, Georgia, Arizona, Texas, and Florida. If you come to Indiana, Georgia, Arizona, Texas, or Florida to pick up the item, (no matter if the order was placed over the phone or internet from another state), you will pay sales tax to the State. The short explanation is this: Because we have physical locations in Indiana, Georgia, and Arizona, Texas, and Florida, we are required by law to collect the Indiana, Georgia, Arizona, Texas, or Florida sales tax if an item is picked up at our facility or shipped to an Indiana, Georgia, Arizona, Texas, or Florida address.

If you are buying the item for resale and you can provide a valid retail merchant certificate (tax id number), we will not collect the state tax, but you will be responsible for collecting the state tax from your customer.
Think about this situation: If you were to visit an Indiana, Georgia, Arizona, Texas or Florida restaurant, the restaurant would charge you sales tax. You would not be able to call from your respective state, tell the restaurant you would like to pay in advance, and then come to Indiana, Georgia, Arizona, Texas, or Florida and eat your meal tax free. Please also note that these laws are not specific to Indiana, Georgia, Arizona, Texas, or Florida, but apply to most other states throughout the U.S. Any Indiana, Georgia, Arizona, Texas, or Florida company and/or customer that does not follow this policy is acting outside the scope of the applicable Indiana, Georgia, Arizona, Texas, or Florida sales tax laws, and both the company AND customer run the risk of being subject to penalty and/or punishment.

We also honor farm exemption certificates. Each State defines what equipment may qualify for farm use sales tax exemption. If you own a farm and your State provides you an exemption status for equipment purchases, then we will "honor" the exemption if you fill out the proper forms.

Greg Smith Equipment ships all its lifts or large equipment by common carrier or a dedicated long haul truck (on large orders). The products are commonly loaded on a freight truck at our warehouse and then go to one or two transfer stations. You may pick up your merchandise at the closest terminal or have the equipment delivered to a convenient address. The customer is ALWAYS responsible for unloading the delivery semi truck. (van style or flatbed). It is MUCH EASIER for EVERYONE (customer and truck driver) to have the product delivered to a BUSINESS address rather than to a RESIDENCE.

NOTE: It is important that the customer realize that the freight truck is normally a full length tractor-trailer (48'-53') and cannot easily maneuver in residential areas. The shipping company is contracted (ONLY) to deliver the merchandise. It is the customer's responsibility to unload the truck.

Your freight will be securely packaged and in excellent condition when it leaves our facility (you can see pictures of how we package our lifts and equipment on our website). We take digital pictures of most larger shipments before they leave our docks. If a shipment is damaged when it arrives, you must sign "damaged" on the freight bill and make notes regarding the damage. Digital photos make filing a claim much easier. If you believe you have damages (concealed or evident) then take pictures right away. Most people have cell phones with cameras. Please read all of the instructional and warning stickers before opening the package (s) and signing the freight bill release forms.

IF YOU THINK THERE MIGHT BE SOME DAMAGE...then note that on the bill of lading.

NOTE: It is important that you, the customer, understand that we are not the shipping company. We will do everything we can to make sure your package is safe and secure, but when your product leaves our dock, it is consigned to you and if do not inspect the shipment and make notes as to damaged products on the bill of lading, then recovery of damages will be next to impossible

We know that Price is a very important factor, however, we will not sell you a piece of equipment that we believe would not perform properly is unsafe. If you call us and want to buy one of our $1,495 above ground lifts that you expect will lift a one ton diesel dually (safely)...we will ask you to either spend some extra money and get a more heavy-duty lift that will safely perform the operation...or ask you to call another company. Greg Smith Equipment knows there are several other lift distributors that will tell you a $1,495 lift is perfect for a one ton diesel dually. They are wrong.

Most of the products sold by Greg Smith Equipment are manufactured in Asia. We do not hide this fact. We could not offer the incredible pricing on all of our equipment if it was made in North America.

Certain distributors try to deceive customers by incorporating the name USA, America or American into the name of their company. Most of the products sold by these distributors are also made in Asia.

Greg Smith Equipment realized many years ago that automotive service equipment that was manufactured in the USA, Germany, and Italy was becoming too expensive for the average auto repair shop. Over a decade ago, Asian manufacturers began producing "look alike" tire changers, above ground lifts, alignment machines, and other automotive aftermarket equipment. Greg Smith Equipment and four of the largest and most respected Asian auto service equipment manufacturers have partnered in the past twelve years to design, manufacture, and deliver Asian products that offer low prices, commercial grade quality and are supported by a USA based parts department.

Greg Smith Equipment Sales is involved in the majority of decisions affecting the manufacturing of our products. These decisions relate to design, testing, packaging, and printed material. We do not attempt to deceive our customers into believing that our equipment is made in the USA. We are not happy that the USA cannot œprice compete effectively with many of the Asian manufacturers. However, we realize that our customers demand low prices coupled with the highest quality.

To better understand the phrase "Made in America" (according to the FTC), please read:

"For a product to be called Made in the USA, or claimed to be of domestic origin without qualification or limits on the claim, the product must be "all or virtually all" made in the U.S. The term "United States," as referred to in the Enforcement Policy Statement, includes: The 50 States, the District of Columbia, and the U.S. territories and possessions."

What does "all or virtually all" mean?

"All or virtually all" means that all significant parts and processing that go into the product must be of U.S. origin. That is, the product should contain no -------- or negligible foreign content.

Please be sure to ask any other distributors if their "USA made" products pass this litmus test! I am sure that certain distributors will be surprised that you, Mr. Customer, would be familiar with the "Made in USA" benchmark standards. Good luck and have fun with your new knowledge!

Greg Smith Equipment stocks over 90% of the products we advertise. If we are temporarily out of a product-we post that fact on our web site. If you call, and we have "just run out of a certain item"-we will tell you upfront and give you an accurate estimated time as to when your product will ship.

We do NOT take your money weeks before the product ships. Many of our competitors have a very limited working capital. They need your money to buy a container of product from China. If it takes four to eight weeks to get their products-how long will it take to get their parts? How many times have you called your supplier just to get the "run around"?

We stock the best products and sell them at the lowest possible prices. We do not understand why certain people would want to pay more for less; and then wait two months for the product. But-hey”this is America and freedom of choice is a great thing!
